TERMS AND CONDITIONS
1. Definitions
The Goods - these are the items that you wish to sell and are covered by this agreement.
The Selling Period - this a period of 28 days from the date of our representatives visit and your confirmation of instruction. This period may be extended subject to yours and our agreement.
Customer Record Sheet - this is a written record of the goods - the Customer Record Sheet will be issued to you by our representative following our photographing of the goods.
The Buyer - this is the person or persons that have purchased the goods from Cash2Clear.
Purchase Price - this is the total amount paid for the goods by the buyer and includes postage and packing.
Net Sales Price - this is the net amount recieved for the goods once our commission and postage and packing costs have been deducted from the Purchase Price
2. Your Obligations
You will have the goods ready for our representative to photograph at your home.You will keep the goods in a safe place during the selling period and agree not to remove them or sell them during the selling period
You confirm that all items are your own and are not counterfeit, stolen or restricted and that you are not constrained from selling them in any way. You will notify us of any defects, faults or anything material to the value of the item.
You will not act in any way which will interfere with the proper and fair progress of the sales process once underway.
You will indemnify us against any loss or damage, including loss of commission, due to breaches of the above obligations. You understand that you will not be able to withdraw items from the sales process and agree to pay us the sum of £20 for any item that is withdrawn, lost or damaged during the Selling Period.
You authorise us without further notice to enter you into a binding sales contract with a buyer and agree that full legal title will transfer directly to them when they have paid us for the item.
You will ensure that the goods are available to collect within 72 hours of an item being sold.
2. Our Obligations
We will photograph and record the goods and smaller items will be boxed in packaging we will provide. We will advise you of any items that we consider to be unsaleable and this will be entirely at our discretion.
We will act as your selling agent and will use our best endeavours to obtain the best price we can for the goods. We will decide on the best method of sales for each of your items and will notify you of this once the goods have been registered on our database. Some items may be sold on e-bay, our own e-shop or our affiliated websites.
We will provide you with a Customer Record Sheet that will itemise all goods to be sold and any minimum price you require for an item.
At the end of The Selling Period, we will notify you of which items have been sold and we will arrange collection of these so that they can delivered to the buyer. In some case, collection will be during the Selling Period.
3. General
These terms and conditions form the complete agreement under which you (as a seller of items) will do business with us, Cash2Clear. This Agreement constitutes the entire agreement and understanding between you and us in relation to the subject matter thereof.
We may at any time update these terms and conditions by publishing new terms and conditions on our website which shall constitute notice to you of any such change.
Any new terms and conditions so published will supersede these from their time of publication. These terms and conditions are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the English Courts.
4. Payment/Fees
Our commission which is shown under Our Fees and any postage costs will be deducted from monies we receive during the sale process and the balance will be paid to you within 14 days of the end of the Selling Period. Payment will be made either by cheque or BACS. You will be paid the Net Sales Price for goods as defined in item 1.
